This contract is made between:

(1) Daisy Scan Limited ("Daisyscan") ("we" "us") and (2) you, the customer ("you") and shall be governed by the following terms and conditions of sale ("conditions"), none of which will affect your statutory rights:

Our Services
Details of the scans that we provide can be found on the Daisyscan website (www.daisyscan.co.uk). We reserve the right to modify or improve our service(s) without prior notice. We provide non-diagnostic ultrasound scans for pregnant women. All of our scans are completed by fully trained and registered medical professionals specialising in fetal ultrasound (in these Conditions referred to as sonographer(s)). With your consent, we will carry out a fetal ultrasound scan of you baby. The primary purpose of the scan is to check the health and well-being of the fetus and to capture 2D, 3D & 4D images. The scan will check the size and growth of your baby, will check for multiple fetuses, show the presentation of the fetus and position of the placenta. If your sonographer believes that there is any area of your baby's development that needs to be brought to your attention, they will discuss their findings openly with you. In these circumstances, we will refer you to your NHS care provider for a diagnostic investigation. With your permission, we will send a copy of your report to your NHS care provider. It is then your responsibility to ensure you consult you NHS care provider.
Our scans are designed to be performed at specific stages of your pregnancy. The only genuinely accurate way to establish the gestational age of a foetus is via ultrasound, however your gestational age can be estimated by using your LMP (the first date of your last menstrual period). This method is widely used in the NHS. If your true gestational age is discovered to be less than the limits of your chosen package, you may choose to book another scan at a later date. As this is outside of our control, a free rescan will not be applicable. The National guidelines to whose standards we operate, recommends that a period of 14 days should pass before a second early Reassurance Scan is performed.

Information we require in order to provide the services
We will need certain information from you in order to provide the services (for example, hospital notes and pregnancy history). If you do not provide us with this information or provide incorrect or incomplete information, we may either end the contract or charge you a reasonable sum for the additional work undertaken to obtain the correct information. We will not be responsible for any delays in supplying the services if you do not provide the information.

Use of Daisyscan website and disclaimers
Any access to online services, information or the Daisyscan website is provided "as is" and on an "as available" basis. We give no warranty that the service will be free of defects and / or faults. To the maximum extent permitted by the law, the material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy. Daisyscan is under to obligation to update information on the website. Daisyscan accepts no liability for any disruption or non-availability of the website.
Daisyscan reserves the right to change, suspend or discontinue any part (or the whole) of the website including, but not limited to, any products and / or services available. Where our website contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Medical History
We will not have access to your medical history and records at any time before, during or after your scan is performed and therefore cannot provide medical advice relating to any diagnosis or advise you on any diagnostic results. You understand that the primary purpose of the scan is not to discover anomalies or abnormalities and that the report completed is a brief non-diagnostic overview of your pregnancy and is often completed at a gestation different to your NHS scans. As such, the detection rate of abnormalities may be reduced. It is therefore imperative that you access all antenatal services made available to you by the NHS as the identification of abnormalities is their primary aim and intent. You also understand that your scan is not suitable to be considered as a diagnostic assessment of your pregnancy and is not exhaustive to all genetic scenarios. Not all abnormalities are screened for or detectable using ultrasound.

Method
The majority of our scans are preformed abdominally, so please attend in clothing that makes it easy to expose our abdomen. In some cases, during early pregnancy, we may offer you an internal / transvaginal scan to improve accuracy. Your sonographer will discuss this with you and your dignity will be maintained at all times. This will only be carried out with your consent. If you decline an internal scan, you accept that we may not be able to provide you with conclusive information.

Price and Payment Terms
The price of our scans will be set out in our price list on our website. Our Prices may change from time to time, but changes will not affect any Price which we have already confirmed with an Appointment Confirmation. We take all care to ensure that the Prices quoted on our website are correct at the time when the relevant information was entered into the system. It is always possible that, despite our reasonable efforts, some of the Scans on our website may be incorrectly priced. If we discover an error in the Prices, we will inform you of this error and we will give you the option of continuing to book the Scan at the correct price. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Scan to you at the incorrect (lower) price. We accept payment in cash or by most major debit or credit cards.

Photography and Recording
We do not allow any personal photography or recording to be carried out in our clinics.

Age
You must be 18 years old or over to use our services.

How we accept your order
Our acceptance of your order will take place when you make a payment of the non-refundable booking deposit of £30. If we are unable to accept your order, we will inform you of this in writing and we will not charge you. This might be because of unexpected limits on our resources which we could not reasonably plan. Payment of the balance of the cost of the Scan (Price) will become due and payable directly preceding the appointment time.

Right to make changes
If you wish to make a change to the services or products you have ordered, please contact us. We will let you know whether the change is possible. You must give us 48 hours' notice if you wish to change the date or time of your scan. Failure to do so will result in forfeiture of your non-refundable, booking deposit of £30.

Cancellation and Refunds
You have the right to end the contract for the supply of services before you have received the services, but you will not be entitled to the non-refundable, booking deposit of £30 if at any time you cancel or we have already carried out the services. See the "Summary of your legal rights" box for more information. Failing to inform the clinic when you are late for more than 10 minutes and not attending your appointment, we reserve the right to charge the full price and cancel your appointment. We reserve the right to suspend or cancel the services if you do not pay us when you are required to or provide us with the information needed to carry out the services. We will refund you any money you have paid in advance if we have not provided the services but may deduct reasonable costs we incur as a result.

Events outside our control
If we have to delay or amend the date or time of your appointment due to an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. This may be as a result of (but not limited to) any technical issues, changes in law or regulatory requirements. Provided we do this we will not be liable for delays caused by the event. If there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.

Our right to Change the Terms and Conditions
We may revise the Terms and Conditions at any time by amending them. You are expected to check this page from time to time to take notice of any changes we have made.

Our Liability to You
We shall not be responsible or liable for any injury, loss or damage to personal belongings whilst you are in our premises. We are only liable for our failure to comply with these Conditions and accept responsibility for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or not caused by us breaking the contract. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew that it might happen, for example, if you discussed it with us during the consultation. We are not liable for any business losses as we only provide the services for domestic and private use. We do not exclude or limit in any way our liability to you where it would be unlawful to do so.

What you will receive following the scan
You will receive an obstetric report and / or a scan report and / or a well-being report depending on which scan you have purchased.

Property and Image Rights
We retain copyright of any images that we take. Ownership of the Report shall belong to you once we receive payment in full for the services.

What we cannot guarantee
We will undertake to provide you with the best images possible but you understand that your baby's position during the scan, along with other contributing factors, are outside our control. We will use reasonable efforts to ensure that your appointment will run on time. In relation to gender scans, we cannot guarantee the accuracy of the gender identification. We will undertake to do our best to identify the sex of your baby. We accept no liability for any incorrect indication of your baby's gender.

How we use your personal data
We only use your personal information in accordance with our Privacy Policy. For details, please see our Privacy Policy. We will retain copies of your scan for 30 days in order to rectify any issues you may have following the scan, or assist with any issues you might have beyond your pregnancy.

Data Protection and Patient Consent
As a healthcare provider, Daisy Scan Limited will process healthcare related data (special category). By giving us consent to process your data, you consent to:
- Allowing us to process your data for the purposes of (but not limited to), preventative medicine and / or medical diagnosis.

Enforceability & Jurisdiction
This contract is between you and us. No other person shall have any rights to enforce any of its the Terms & Conditions, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise and we and you will not need their consent to cancel or make any changes to the Terms & Conditions.

Each of the paragraphs of the Terms & Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

This agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Your rights under the Consumer Rights Act
You can ask us to repeat or fix a service if it's not carried out with reasonable care and skill, or get some money back if we can't fix it. If your product is goods (i.e., a picture), the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality.
